A truck driver has been charged with negligent homicide after running over a construction worker in West Virginia on Monday. 

The accident happened on April 14th at about 11 a.m. at an Interstate 77/West Virginia Turnpike work zone south of Charleston, West Virginia. 

According to West Virginia Metro News, truck driver Anvar Sabirov failed to move into the correct lane in a work zone, and was forced to swerve to avoid colliding with a dump truck. He then ran over a Turnpike worker who was patching a hole in the roadway. 

The Turnpike worker died a short time after the accident. He has only been identified as a man in his 20s. Sabirov stopped at the scene and cooperated with police. He has been charged with negligent homicide. 

A criminal complaint alleges that there is video of Sabirov looking down as he entered the work zone. Sabirov told investigators that he was not on his phone prior to the crash. Police are reviewing footage from a dash cam on the tractor trailer and records from his cell phone.
