The truck driver found speaking with a pregnant teen and her 40-year-old baby daddy at a Nebraska truck stop was not arrested for the incident.
The pregnant teen had been missing since early February and was finally found, along with the 40-year-old father of her unborn child, at a Love’s in Sarpy County, Nebraska, on Wednesday, April 3rd.
According to Fox 11, a clerk at the truck stop noticed the young girl talking with the truck driver and a middle aged man and found it to be suspicious. She went up to talk to them, but their stories did not add up, so she walked away. The clerk then looked up current Amber alerts and found a listing for the pregnant teen, so she contacted police.
“The female reporting party said, ‘It just doesn’t seem right on what they’re doing together’ and it was very inconsistent, and that’s why she called 911,” Sarpy Co. Sheriff Greg London said.
Police arrived at the truck stop and confronted the group of three. 40-year-old Gary Day, who was traveling with 17-year-old Sophia Franklin, initially gave them a fake name. He had also recently grown out his facial hair in an attempt to change his appearance. Day was soon taken into custody without incident, a Franklin was taken to a nearby hospital to be checked out. She and her unborn baby are in good health.
“[Her] parents were contacted and as far as I know, the parents are coming to Nebraska to reunite with their daughter,” London said.
The truck driver who was speaking with the hitchhiking couple reportedly did not know who he was talking to or what their situation was. He was not arrested or charged for his brief involvement in the incident.
Day has since pleaded not guilty to two misdemeanors – contributing to the delinquency of a minor and providing false name to law enforcement. He is also facing charges in both Vermont and Indiana for exploitation. He is expected to appear in court on Friday afternoon, April 4th.
