A woman left “hanging upside down” in her vehicle is the first to file a lawsuit in the deadly crash on Highway 43 involving a truck driver on a work visa. 

The accident happened on Tuesday, May 6th, when 45-year-old Andrii Dmyterko crashed into four vehicles sitting at a red light in Thomasville, Alabama. The crash killed two people, injured four people, and landed Dmyterko behind bars on manslaughter charges. Since then, Dmyterko’s work visa has been revoked, and the FBI has become actively involved in the case. Dmyterko’s co-driver has also been interviewed by the FBI and ICE as the organizations work to investigate the case.

Now, Nancy Calvert has filed a lawsuit against Dmyterko and his employers after suffering injuries in the crash. The suit was filed in the Clarke County Circuit Court and names 4 US Freight LLC, 4 US Transportation Company, 4 US Corporation, and Andrii Dmyterko as defendants. 

The lawsuit states that Calvert was left with serious injuries after her vehicle was struck by Dmyterko. 

“Following the impact, Calvert was left hanging upside down – strapped in by her seat belt and unable to extract herself from the vehicle,” the complaint says according to AL News. “Calvert is fortunate to have been pulled from her vehicle by two bystanders, whom she views as heroes and wishes to be able to personally thank.”

“Shortly after being pulled from her Nissan Rouge, it caught fire and burned. Calvert is blessed to have survived. Calvert was transported by ambulance to Grove Hill Memorial Hospital where she received treatment with additional treatment to come.”

The suit also alleges that Dymterko was “distracted and/or inattentive and/or impaired,” which caused the crash. Video of the crash appears to show no sign of Dymterko hitting the brakes before impact. 

“We are committed to fully investigating this matter and are confident that all the facts will come out,” said Josh Hayes, attorney for Calvert.
